COPYRIGHT AND WHAT YOU SHOULD KNOW

Why do I want you to read these? I'm an artist, and as such I make a living with my photography & art. When you steal from me, you affect my income potential. If you can't afford to purchase it then you can't have it. Such is life. I want a new Porsche, but I can't afford it so I don't have it. In some cases, if you come to me, we can work out payments or barter for what you want. But please don't steal from me. I promise I won't steal from you but I will sue if you steal from me!

Here are a few of the people that have violated my copyright agreement in the past year:

  • Chad Bruster
  • Tina Perkins (Chad's Girlfriend')

If I find one of my pictures on your page without my permission, I will tell you to take it down once if you're lucky and then I will be per suing legal avenues.

If I've taken your picture for what ever reason, here is what you have agreed to:

Limited Use License (Grant)

For consideration which I acknowledge, I grant to ________________________________________ ("Company") and Company's assigns, licensees and successors, the right to use my image (s) that are directly given to the company by me for the following purposes: Posting on Website Portfolio for Self-Promotion or Personal Use under these conditions:

  1. Credit is given to Clayton Bruster for the photography
  2. A link (if possible) is given to Clayton Bruster's portfolio on same site or to http:// brusterphotography.com
  3. Image is not altered or edited in any wayThis right is for a period of (10) Ten year(s) (the "Term").

    I grant and require the right to use my name and image for the purposes listed above in all forms and media. Payment

    For the rights granted during the Term, Company shall pay $ ______________ upon execution of this release. Release

    I release Company and Company's assigns, licensees and successors from any claims that may arise regarding the use of my image including any claims of defamation, invasion of privacy, or infringement of moral rights, rights of publicity or copyright. Company is obligated to include my name as a credit in connection with the image as well as link to my portfolio if allowed.

    What you can do with digital copies of images I gave you:

    • Post them on websites, blogs and pages: as is without any changes what so ever

    What you can't do with digital images I gave you:

    • Edit, Print, Alter in any way, Scan, or post without the following criteria
      • Link to my page
      • Give me a credit line for taking the picture
      • Tag and refer to my web page as on MySpace
      • Link to my photographer page if on a modeling site

    What you can do with prints you received from me:

    • Nothing but frame it, put it in a portfolio, put it in a photo album.

    What you can't do with digital images I gave you:

    • Edit, Print, Alter in any way, Scan or duplicate in any way.

    NOTE

    If you see a picture I took of you on one of my sites but I have not given it to you, it's not yours! If you want a copy, ask! I'm pretty good about giving you copies of new edits if you ask for them. If you take it, I will sue you and possibly the site you got it from.
